Expert Witness and Litigation Consulting Services

We provide independent, technically rigorous support across the full lifecycle of healthcare AI litigation — from initial case evaluation through to expert testimony.

01

Preliminary Case Assessment

An efficient, focused evaluation of whether a matter has merit from a clinical AI perspective — before significant resources are committed.

Many healthcare AI matters require early technical evaluation to determine whether a viable claim or defence exists. Our preliminary assessment service provides counsel with an independent expert opinion on the core technical and clinical questions, without the cost and time commitment of a full expert witness engagement.

Assessments are conducted under a limited engagement arrangement and are scoped to the specific questions most relevant to early case strategy. Findings are delivered in a structured written report suitable for use in counsel's internal deliberations.

This service includes

  • Review of available technical documentation and clinical records
  • Evaluation of the AI system's design, validation, and deployment context
  • Assessment of the causal relationship between system behaviour and alleged harm
  • Written summary of findings and preliminary expert opinion

02

Litigation Consulting

Ongoing technical and strategic support throughout the litigation process, from discovery through to trial preparation.

Litigation involving healthcare AI systems presents distinctive challenges at every stage of the legal process. Technical concepts must be translated into legally actionable terms; discovery requests must be calibrated to the architecture of AI systems; and opposing expert opinions must be evaluated with precision.

Our litigation consulting service provides counsel with a sustained expert resource throughout the matter. We work alongside legal teams to inform strategy, review materials, and prepare for each stage of the proceeding.

This service includes

  • Technical review of opposing expert reports and supporting materials
  • Assistance with discovery strategy and document requests specific to AI systems
  • Preparation of technical questions for deposition and cross-examination
  • Ongoing advisory support as the matter develops
  • Briefing materials and technical summaries for counsel and client

03

Expert Witness Services

Independent expert testimony and formal opinion for deposition, arbitration, and trial proceedings.

Our expert witness engagements are accepted selectively, with attention to subject-matter fit, genuine independence, and the capacity to provide thorough, timely analysis. We do not accept engagements in which we cannot provide an independent opinion, regardless of which party retains us.

Expert reports are prepared to the standards required by applicable procedural rules and are written to be accessible to lay decision-makers without sacrificing technical accuracy. Experts are available for deposition, arbitration, and trial testimony.

This service includes

  • Comprehensive review of case materials, technical documentation, and clinical records
  • Preparation of expert report to applicable procedural standards
  • Rebuttal report addressing opposing expert opinions where required
  • Deposition preparation and testimony
  • Trial testimony and demonstrative support

04

Multidisciplinary Expert Support

Coordinated access to a network of specialists across clinical medicine, biomedical informatics, regulatory science, and healthcare systems.

Complex healthcare AI matters frequently require expertise that spans multiple disciplines. A single AI-related adverse event may implicate questions of clinical practice, device regulation, algorithmic design, institutional governance, and patient safety — each requiring a different specialist perspective.

Medical AI Expert Group maintains relationships with specialists across the relevant disciplines and can coordinate multidisciplinary expert support for matters that require it. We act as the primary point of contact for counsel, managing the engagement and ensuring consistency of approach across the expert team.

This service includes

  • Clinical specialists across relevant medical disciplines
  • Biomedical informatics and health data science expertise
  • Regulatory science and FDA/international device framework expertise
  • Healthcare systems and institutional governance expertise
  • Coordinated engagement management and consistent expert communication

Engagement Process

How We Work

01

Initial Inquiry

Submit a brief, non-confidential description of your matter. We will review your inquiry and respond within two business days to discuss whether and how we can assist.

02

Conflict Check

Before any confidential information is shared, we conduct a conflict of interest check. Engagement arrangements are formalised before case materials are reviewed.

03

Scoping and Engagement

We agree the scope, deliverables, and timeline for the engagement. Preliminary assessments are typically completed within two to three weeks; full expert witness engagements are scoped to the matter.

04

Analysis and Delivery

We conduct our analysis independently and deliver findings in the agreed form — written report, oral briefing, or formal expert opinion — to the agreed standard and timeline.

Discuss Your Matter

If you are evaluating a potential claim or seeking expert support for an existing matter, we welcome an initial conversation.
